• Viral Outliers does not claim ownership over any content originating on Third-Party Platforms and uses such content solely for trend analysis and pattern recognition.
• Viral Outliers makes no representation that any trend, format, sound, or creative style identified on a Third-Party Platform is free for commercial use. Specific sounds, music tracks, visual effects, and branded formats may be subject to separate copyright or licensing requirements.

API, Connectors & Agent Access

Viral Outliers offers a REST API and an MCP server that let you (or AI agents and tools acting on your behalf, such as Claude or ChatGPT connectors) access the platform programmatically. Access requires an API key created in your account Settings. By using the API or connecting an agent you acknowledge and agree to the following:

• Your keys are your responsibility. API keys are tied to your account. You are responsible for keeping them secret and for all activity performed with them. Anyone who has your key can spend your credits. If you believe a key has been exposed, revoke it in Settings immediately.
• Fair use. We may rate-limit, suspend, or revoke API keys or agent access at any time where we believe there is abuse, unusual load, a security risk, or a breach of these Terms and Conditions.

When using the API or connectors you must not:

• Resell, sublicense, or redistribute raw data access obtained through the API without our prior written agreement;
• Use the API or connectors to violate the Terms of Service of any Third-Party Platform or any applicable law; or
• Attempt to bypass, circumvent, or interfere with rate limits, credit accounting, or any other technical restriction we put in place.

API Credits

Paid actions performed through the API or connectors (such as crawling a public social-media profile on demand, AI transcription of posts, or data search) consume API credits. Credits can be purchased as one-time packs or are included as a monthly allowance with certain subscription plans. By purchasing or using credits you acknowledge and agree to the following:

• Prepaid and consumed per call. Credits are prepaid and deducted per API call according to the price list published on our website, which we may update from time to time.
• Non-refundable once used. Once a credit has been spent on a call or job that was carried out, it cannot be refunded. If a job fails on our side, the credits consumed by that job are automatically refunded to your credit balance.
• No cash value. Credits have no monetary value, cannot be exchanged for cash, and are non-transferable. Any remaining credits expire when your account is closed.

No Warranty & Limitation of Liability for API and Agent Usage

The API, the MCP server, connectors, and everything they return (including AI-generated transcripts, analyses, and crawled data) are provided "as is" and "as available", without any warranty of accuracy, completeness, fitness for a particular purpose, or uninterrupted availability. By using them you acknowledge and agree to the following:

• Your decisions are your own. Viral Outliers is not responsible for business decisions, losses, or other consequences resulting from your use of the API, connectors, or the data they return, whether that use is by you directly or by an AI agent acting on your behalf.
• Errors and interruptions. We are not liable for errors, omissions, delays, or downtime, or for changes made by Third-Party Platforms that affect the data we can crawl or return.
• Liability cap. To the maximum extent permitted by applicable law, our total liability arising out of your use of the API, connectors, or credits shall not exceed the fees you paid to us in the month preceding the event giving rise to the claim.

DMCA & Copyright Infringement Notices

Viral Outliers respects the intellectual property rights of others and expects its users to do the same. If you believe that material available through our service infringes your copyright, you may submit a written notice to us at info@viraloutliers.comwith the subject line "Copyright Infringement Notice". Your notice must include:

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• exclude any of our or your liabilities that may not be excluded under applicable law.

Subject to the above, we accept no liability for:

• loss of revenue due to suboptimal app functioning. The end user is responsible for testing the app in the end environment.
• any intellectual property infringement, including copyright or trademark claims, arising from content generated, inspired by, or derived from the platform's output.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
